How to complete this agreement
Complete Schedules A, B, C and G for every driver. Complete Schedule D for an Aryan Travels vehicle, Schedule E for the driver’s own vehicle, and Schedule H where the driver is an employee. Use Schedule F for trip and incident records.
Before signature: Complete every blank, confirm the contracting party’s full legal identity, select the correct relationship status, enter the agreed payment and work terms, and verify the vehicle documents and operating permissions. Do not activate a driver until the applicable schedules are complete and reviewed.
☐ Determine employee or independent service-provider status from the actual facts and working practices. The label in this document does not determine legal status. Obtain local advocate review before selecting the status.
☐ Complete the commission or fixed-fee rate, calculation basis, payment cycle, expenses, working-time terms where applicable, service area, cancellation/waiting rules, term, notice, and contacts before signature.
☐ The Driver bears routine trip expenses. Vehicle ownership costs remain with the vehicle owner. Any exception or reimbursement must be recorded in Schedule B and approved in writing before the expense is incurred.
☐ Do not add a deposit, penalty, automatic deduction, exclusivity term, or minimum-work promise unless the Parties expressly agree it in writing and it has been reviewed for legality.
☐ Confirm the final signing format and applicable stamp duty before execution.
Use one signed agreement per driver. If the driver uses both vehicle arrangements, identify the applicable arrangement on each Trip record and complete both vehicle schedules.

Terms of the agreement
1 Purpose and definitions
1.1 Aryan Travels arranges passenger transport services from Vellore and nearby areas, including local travel, airport transfers, intercity and outstation trips, and special-duty bookings, subject to vehicle permits and the trip terms.
1.2 “Trip” means a passenger transport assignment confirmed by Aryan Travels and accepted by the Driver. “Vehicle” means the vehicle recorded in Schedule C or Schedule D for that Trip. “Customer” means a passenger or booking client served through Aryan Travels.
1.3 A booking is confirmed only when Aryan Travels communicates the agreed pickup, destination, date, reporting time, vehicle class, fare or billing basis, and any special instructions through an approved channel.
2 Engagement and selected track
2.1 Before signing, the Parties must complete Schedule A and select one vehicle track for each driver and, where needed, one relationship status. The selected track and commercial terms apply only to the extent they match the actual arrangement.
2.2 Vehicle-owner driver track: The Driver supplies and operates the Driver’s own vehicle or a vehicle the Driver is authorised to use. The Driver’s own vehicle and its permitted commercial use must be recorded in Schedule C.
2.3 Aryan Travels vehicle track: Aryan Travels makes a company vehicle available for accepted duties, subject to a signed handover record in Schedule D. The Driver may use it only for authorised Trips and related approved movements.
2.4 Status must match the facts. The Parties must select in Schedule A whether the Driver is employed by Aryan Travels or is an independent service provider. The label in this Agreement does not decide legal status. Counsel should assess the actual facts, including who controls working hours and manner of work, whether trips can be declined, whether the Driver may serve other clients, who supplies the vehicle and bears business expenses, and how payment is calculated.
2.5 If the Driver is an employee, the employment terms and statutory protections that apply to the actual establishment and role will govern. Nothing in this Agreement waives a right that cannot lawfully be waived. Complete Schedule H for employment terms and Schedule B for the relevant trip, vehicle, and payment details.
2.6 If the Driver is an independent service provider, this arrangement is intended to apply to accepted Trips, with no guaranteed number of Trips or earnings unless specifically written in Schedule B. The Parties must confirm that operational practice is consistent with this arrangement.
2.7 No term authorises either Party to violate a permit, insurance condition, employment requirement, road-safety rule, or other applicable law.
3 Services and trip assignment
3.1 Aryan Travels may offer Trips based on availability, vehicle category, location, customer requirements, and legal operating permissions. The Driver must confirm acceptance before being treated as assigned.
3.2 Before acceptance, the Driver may decline an offered Trip. After acceptance, the Driver must promptly report any emergency, delay, breakdown, or safety concern that may affect service. Any cancellation charge or driver compensation for a cancelled Trip must be written in Schedule B and must be lawful and reasonable.
3.3 The Driver must not change the fare, destination, route, vehicle, driver, passenger count, or agreed service without the customer’s approval and Aryan Travels’ approval, except where needed for safety or required by an authority.
3.4 The Driver must not collect an unapproved amount, solicit an off-book payment, divert a booking, or represent that Aryan Travels has agreed to a term it has not approved. Any cash or digital payment collected for Aryan Travels must be recorded and reconciled under Schedule B.
3.5 The Driver must maintain an accurate trip record showing the booking reference, vehicle and driver, reporting and completion times, odometer readings where relevant, route changes, passenger-authorised extras, tolls and parking, payment mode, and any incident or complaint.
4 Onboarding and eligibility
4.1 Before the Driver is activated, the Parties will complete the onboarding checklist in Schedule C. Aryan Travels may verify documents through the issuing authority or another lawful verification method. The Driver must provide accurate information and promptly report any expiry, suspension, disqualification, restriction, or material change.
4.2 The Driver must hold an effective driving licence authorising the relevant vehicle class and comply with the age and other eligibility requirements that apply to that vehicle and service. A licence copy should be retained securely for the onboarding purpose.
4.3 Before a vehicle is assigned to passenger-for-hire service, the person responsible for it must provide current registration, applicable permit, fitness certificate where required, insurance appropriate to its actual use, pollution certificate where required, tax evidence where required, and any other document required for that vehicle or route. The Driver must not knowingly operate with an expired, suspended, invalid, or materially mismatched document.
4.4 Police or background verification, reference checks, medical or fitness checks, and collection of identity information may be performed only through a lawful, proportionate process, with notice and consent where required. Aryan Travels will limit access and use to legitimate onboarding, safety, compliance, and trip-management purposes.
4.5 Aryan Travels may pause new assignments where a required document is missing, a serious safety risk is credibly reported, or a competent authority restricts operation. Except where immediate action is needed to protect a person or comply with law, the Driver will be told the reason and given a reasonable opportunity to respond.
5 Driver service standards
5.1 The Driver must arrive at the agreed reporting point on time, confirm arrival through the approved channel, verify the passenger or booking details, and drive carefully and courteously.
5.2 The Driver must comply with traffic laws, passenger capacity, seat-belt requirements, route restrictions, permit conditions, lawful police or transport-authority directions, and any safety instruction communicated for the Trip.
5.3 The Driver must not drive while impaired by alcohol, drugs, medication that makes driving unsafe, severe fatigue, illness, or another condition that prevents safe driving. The Driver must not use a handheld phone while driving, engage in rash driving, smoke in the vehicle, harass or discriminate against a passenger, or permit an unauthorised person to drive.
5.4 The Driver must not photograph, record, publish, or share a passenger’s image, conversation, contact details, trip location, or other personal information without a lawful basis and any required permission. A recording required for safety or law must be handled only under Aryan Travels’ written policy and applicable law.
5.5 The Driver must keep the passenger cabin reasonably clean and presentable, maintain a courteous manner, assist with ordinary boarding needs where safe, and promptly report lost property. The Driver must not refuse a passenger or change a route on a prohibited discriminatory basis.
5.6 The Driver must follow reasonable customer-service standards and training notified in writing. Any uniform, grooming standard, identification card, or vehicle branding requirement must be listed in Schedule B or Schedule C and supplied or paid for as legally required.
6 Vehicle owner driver obligations
6.1 For the own-vehicle track, the Driver or vehicle owner must keep the Vehicle in safe operating condition and arrange servicing, tyres, repairs, cleaning, and required inspections, unless Schedule B expressly allocates a particular cost differently.
6.2 The Driver or vehicle owner must maintain the registration, fitness, permit, insurance, tax, pollution certificate, and other approvals that apply to the Vehicle and Trip. The Driver must tell Aryan Travels immediately if the Vehicle becomes unsafe or any relevant document expires, is suspended, or is changed.
6.3 The Vehicle must not be substituted, leased, sold, transferred, or operated by another driver for an accepted Trip without prior approval and updated document checks. Aryan Travels may inspect the Vehicle at reasonable times for service and safety purposes.
6.4 For the own-vehicle track, the Driver or vehicle owner bears fuel, routine maintenance, tyres, insurance premiums, vehicle taxes, and other costs attached to owning and operating that Vehicle, subject to applicable law and any express allocation in Schedule B. Any expense Aryan Travels agrees to reimburse must be approved in writing before it is incurred.
7 Aryan Travels vehicle obligations and custody
7.1 For the company-vehicle track, Aryan Travels will identify the Vehicle, its condition, fuel level, odometer reading, existing damage, documents handed over, and any accessories in Schedule D.
7.2 Aryan Travels or the registered owner will arrange vehicle registration, permit, insurance, scheduled maintenance, and repairs for an Aryan Travels vehicle, subject to statutory responsibilities. The Driver bears routine trip expenses allocated in Schedule B. The Driver must complete the agreed pre-trip check and report a defect before driving where it may affect safety or legal compliance.
7.3 The Driver must use the Vehicle only for authorised Trips and approved movements, keep keys and documents secure, not lend it or permit another person to drive it, and return it at the agreed location and time with the agreed fuel level, subject to normal use and recorded exceptions.
7.4 A vehicle handover or return must be documented with date, time, odometer, fuel, condition, accessories, photographs where appropriate, and signatures. Existing damage must be recorded before the Driver takes custody.
7.5 The Driver must not be charged automatically for ordinary wear, an unexplained vehicle fault, or every loss occurring during custody. Any claim of damage must be investigated with the handover record, available evidence, insurance terms, causation, and the Driver’s response. Any recovery or wage deduction must be lawful, supported, and separately documented.
8 Compensation and settlement
8.1 The Parties must select one payment method for the relevant track in Schedule B:
• Per-trip commission: ________________% of the agreed commission base. The base must state whether it is the fare before or after discounts, taxes, tolls, parking, refunds, and payment-processing charges.
• Fixed driver fee: ₹________________ per [trip / shift / day / month / other: ________________]. State whether the fee is a wage, service fee, or other payment consistent with the actual legal relationship.
8.2 The payment method, rate, calculation base, incentive terms, expense treatment, statement period, payment date, and payment channel must be completed and initialled by both Parties. No rate is created by this template.
8.3 Aryan Travels will provide a trip or work statement showing completed Trips, the calculation used, approved reimbursements, customer payments received where relevant, and any adjustment with its reason. The Driver may raise a written discrepancy within ________________ days; undisputed amounts will be settled by _____________________________ (date / cycle).
8.4 No penalty, security deposit, chargeback, or deduction may be imposed unless it is expressly recorded, supported by evidence, permitted by applicable law, and accompanied by a fair opportunity for the Driver to respond. No deduction may waive a statutory wage or benefit.
8.5 Where the relationship is employment, wages, overtime, leave pay, statutory contributions, benefits, and final settlement will be handled under the law applicable to the establishment and employee. A per-trip incentive does not replace any statutory minimum or benefit.
8.6 Where the relationship is an independent service arrangement, the Driver or vendor will provide any invoice or tax document required by law. Tax withholding, GST, or other tax treatment will be applied only where legally applicable and after the Parties record the required details.
9 Fuel tolls parking waiting and outstation expenses
9.1 For both vehicle tracks, the Driver bears routine trip expenses, including fuel, tolls, parking, airport charges, waiting charges, and ordinary trip extras, unless Schedule B records a different allocation. For an Aryan Travels vehicle, Aryan Travels or its registered owner bears vehicle ownership costs, including registration, permits, insurance, scheduled maintenance, repairs, and vehicle taxes. For an own-vehicle Trip, the Driver or vehicle owner bears those ownership costs. No expense is reimbursable unless Aryan Travels approves it in writing before it is incurred. If the Driver is an employee, the Parties must obtain advocate review of this allocation under applicable wage and employment law; it must not be used to make an unlawful deduction from wages.
9.2 Customer-facing charges must be communicated in advance where practical and recorded against the booking. Tolls and parking must be charged at actuals unless a lawful published tariff or written package states otherwise. Receipts or electronic transaction evidence must be retained where available.
9.3 Waiting, cancellation, no-show, route change, and additional kilometre or hour terms must be consistent with Aryan Travels’ customer booking terms and be specified in Schedule B. Do not charge a passenger or Driver an amount that has not been agreed or lawfully imposed.
10 Working time and availability
10.1 If the Driver is an employee, Schedule H must state the reporting location, ordinary duty hours or roster method, weekly rest, leave process, overtime approval and payment, and emergency contact process, subject to applicable law. The Parties must not use the Trip sheet to bypass working-time, rest, or wage obligations.
10.2 If the Driver is an independent service provider, availability windows and Trip acceptance rules must be stated in Schedule B. Unless expressly agreed and legally reviewed, no minimum availability or exclusivity is imposed by this template.
10.3 The Driver must not continue driving when fatigue or a health condition makes the Trip unsafe. Aryan Travels must arrange a safe alternative or rescheduling where reasonably practicable.
11 Accidents breakdowns and emergencies
11.1 In an accident, injury, breakdown, vehicle defect, passenger emergency, theft, police stop, or other serious incident, the Driver must first protect life and safety, contact emergency services where needed, notify Aryan Travels promptly, and follow lawful directions.
11.2 The Driver must preserve relevant records and cooperate with police, insurer, vehicle owner, and Aryan Travels. The Driver must not admit legal liability, promise compensation, sign a settlement, or alter evidence on behalf of another Party without authority, except for factual statements required by law.
11.3 Aryan Travels and the Driver must cooperate in notifying the insurer within the required time and provide accurate facts. No Party may instruct the other to conceal, misstate, or delay a report required by law or policy.
12 Insurance risk and responsibility
12.1 The owner or person responsible under law must maintain the insurance required for the Vehicle and its actual use. Before the first Trip and at renewal, the responsible Party will provide current evidence of cover and disclose relevant exclusions or driver restrictions known to it.
12.2 Insurance does not remove a Party’s duty to act lawfully or safely. This Agreement does not limit a passenger’s statutory rights or transfer a non-transferable statutory liability.
12.3 As between the Parties, responsibility for a proven loss will be allocated according to applicable law, the relevant insurance policy, each Party’s acts or omissions, control of the Vehicle or Trip, and reliable evidence. Neither Party is automatically liable for every accident, third-party act, mechanical failure, or passenger loss.
12.4 A Party seeking reimbursement or indemnity must give prompt written notice, provide available records, take reasonable steps to reduce the loss, and allow the other Party a fair opportunity to participate in the response. No settlement that creates liability for the other Party may be made without its written consent, which must not be unreasonably withheld where an urgent lawful response is required.
13 Customer information and confidentiality
13.1 The Driver may use customer names, phone numbers, pickup and drop locations, and trip details only to perform the assigned Trip, address a safety issue, comply with law, or handle an authorised complaint.
13.2 The Driver must not sell, copy, retain, publish, or use customer information for personal marketing or unrelated contact. After the Trip or termination, the Driver must delete or return information in the Driver’s control unless retention is required by law or needed for a documented dispute.
13.3 Aryan Travels will limit access to onboarding and trip information to personnel and service providers who need it for operations, safety, compliance, or dispute handling. The Parties will follow applicable data-protection law and any privacy notice supplied for onboarding.
13.4 Confidentiality does not prevent a person from making a truthful report to a regulator, police, court, insurer, labour authority, or legal adviser, or from exercising a legal right.
14 Branding equipment and training
14.1 Aryan Travels may issue an identification card, uniform, device, trip sheet, vehicle sticker, or other property listed in Schedule C or D. The Driver must use it only for authorised services and return it at the end of the engagement.
14.2 Vehicle branding may be applied only with the vehicle owner’s written consent and after confirming relevant permit and transport-authority requirements. The Driver must not apply another brand or alter a required vehicle marking without approval.
14.3 Before activation, the Driver must complete Aryan Travels’ reasonable induction on booking confirmation, passenger conduct, trip records, complaints, emergency reporting, and customer privacy. Attendance or completion will be recorded.
15 Complaints review and temporary suspension
15.1 Aryan Travels will maintain a channel for the Driver and customer to report service concerns. A serious complaint will be recorded with the date, trip reference, persons contacted, available evidence, and action taken.
15.2 Before imposing a lasting suspension or termination based on disputed misconduct, Aryan Travels will communicate the substance of the concern and allow a reasonable response, except where immediate temporary suspension is needed for safety, document expiry, or legal compliance.
15.3 A rating or allegation alone will not establish fault. Aryan Travels may consider verified records, repeat patterns, training needs, safety risk, and the Driver’s response.
16 Term suspension and termination
16.1 This Agreement starts on _______________________ and continues until ended under this clause, unless Schedule B states a fixed term.
16.2 Either Party may end an independent service arrangement by giving ________________ days’ written notice. An employee’s notice, termination, disciplinary process, final wages, benefits, and other rights will be governed by Schedule H and applicable law; this clause does not override them.
16.3 Aryan Travels may temporarily suspend assignments while it checks a credible safety issue, suspected fraud, licence or permit expiry, insurance concern, serious customer complaint, or authority restriction. The Driver will be told the reason and review process as soon as reasonably practicable.
16.4 A Party may terminate immediately for a serious and substantiated safety threat, material fraud, deliberate misuse of customer data, repeated unauthorised diversion of bookings, or a legal prohibition that prevents performance, subject to any mandatory process and rights under law.
16.5 On termination, the Driver will return company property and vehicle keys, submit trip records and customer payments, and cooperate in a documented handover. Aryan Travels will reconcile undisputed amounts and statutory dues within the time required by law or the agreed payment cycle.
17 Independent service provider terms where selected
17.1 This clause applies only if Schedule A selects independent service provider and the actual facts support that status. The Driver may accept or decline unaccepted offers and may serve other clients, subject to confidentiality, safety, permit, and accepted-Trip commitments.
17.2 The Driver has no authority to bind Aryan Travels, incur expenses in its name, promise customer refunds, or appoint a substitute without written approval.
17.3 Nothing in this clause removes any right or obligation that applies under law based on the actual working relationship. If the facts change materially, the Parties will pause and obtain advice before continuing under this status.
18 Notices and records
18.1 Notices under this Agreement must be sent to the addresses and email or mobile details in Schedule A. Operational Trip messages may be sent through [WhatsApp / phone / dispatch system / other]. A change of contact details must be notified promptly.
18.2 The Parties will retain signed schedules, onboarding acknowledgements, trip statements, expense evidence, handover forms, and incident reports for the period required by applicable law and internal record policy.
19 Disputes and governing law
19.1 The Parties will first try to resolve an operational dispute through a meeting or written exchange between ___________________________________ (Aryan Travels contact) and the Driver within ________________ days of notice, without delaying a statutory complaint or urgent remedy.
19.2 This Agreement is governed by the laws of India as applicable in Tamil Nadu. Subject to mandatory jurisdiction rules, courts having competent jurisdiction at Vellore, Tamil Nadu will hear disputes arising from this Agreement.
19.3 This Agreement does not create an arbitration clause. Any later arbitration term must be separately agreed in writing and reviewed before it is added.
20 General terms
20.1 This Agreement and its completed schedules record the agreed terms for the selected track. If a schedule conflicts with the main text, the schedule controls only for the specific commercial or vehicle detail it addresses, provided it does not contradict applicable law.
20.2 Any amendment must be in writing and acknowledged by both Parties. A change in law or permit condition will apply even if the Agreement has not yet been amended.
20.3 If a provision is unenforceable, it will be read down or severed only to the minimum extent necessary, and the remaining provisions will continue.
20.4 This Agreement may be signed in counterparts or electronically where legally recognised. Each Party confirms it has received a copy of the signed Agreement and completed schedules.
